NBC 7 has obtained a note signed by an unidentified psychologist notifying the City Attorney’s Office that Robert Filner would not be available for a scheduled deposition in a pending sexual harassment case.

The note explains that Filner is currently under the care of an intensive treatment program and will not be able to be questioned in the lawsuit filed by former employee Irene McCormack Jackson as scheduled on August 9.
“Obviously, Mr. Filner does not want to testify under penalty of perjury and will use every means to avoid having to do that,” San Diego City Attorney Jan Goldsmith said in a written statement. “He can delay it, but he can't stop it.”
The name of the doctor was redacted on the note however the illegible signature remains. It’s a flimsy clue into where Mayor Filner has entered a two-week behavioral therapy program.
NBC 7 has been told by several sources that the undisclosed location of the mayor’s rehab is in Los Angeles.
The mayor’s office has refused to divulge where the mayor is or what disorder he suffers from but has assured citizens the business of the city will continue despite his absence.

According to Goldsmith and the plaintiff’s attorney Gloria Allred the deposition has been rescheduled for Sept. 17.
