A former teacher is making one final attempt to get his job back after a sex ad posted on Craigslist cost him his job at a San Diego area school.
Frank Lampedusa, 47, was teaching at Farb Middle School in Tierrasanta when he posted an ad in the men-seeking-men section of Craiglist in 2008. The posting included images of his bare chest and face as well as graphic images of his private parts.
"I was expressing myself doing, something that was totally legal, totally within my realm, late at night in my own house on a private adult website," Lampedusa said.
An anonymous tip led to his termination at the end of the 2008 school year.
The court battles have continued ever since with the Commission on Professional Competence arguing it didn't make him unfit to teach.
The latest ruling came from a State Appeals court found the San Diego Unified School district justified in firing the middle school teacher for immoral conduct. He has until Friday to make what may be one last appeal to the California Supreme Court.
During the appeals process, Lampedusa has been getting paid. Now, after two and half years, money may be drying up along with his legal options.

Lampedusa says the teacher's union recently informed him they will no longer provide legal support.
Lampedusa said he is filled with regret, but doesn't think getting fired is fair.
"I can understand how they would be shocking to somebody who was not expecting to see it,” he said adding, “It was on an adult site."
